Tier 2 Dependent Visa for Partner and Child

Post by pushmurali » Thu Dec 06, 2018 8:36 pm

Hi All,
I am new to this forum. Could you please help me with my query below.
I recently got my ILR Via Tie 2 Route. My wife has Tier 2 Dependent visa which is going to expire 25/12/2018. We have got a child (4 months old) and both are in India now. Should I need to apply Tier 2 Genera Partner visa and Tier 2 General Child visa to bring them here? As I am not in Tier 2 anymore, I am confused which application should they fill? Also, is it correct to apply for both of them at same time or should I get visa for my wife and once my wife has visa then get for my kid? They are applying from India. Please help me.

How long was your wife in the UK on T2 dependent visa?

Now that you have ILR your kid can skip T2 dependent visa and go for BC (but via MN1 I believe).
My advice is based on personal research/experience, so pls check relevant UKVI sources.

My wife had Tier 2 for 1 year 6 months.
But both can be applied via Tier 2 dependent rite?

Normally, child may apply for a PBS dependant visa in line with wife.

If they grant the child's visa in-time, then both may return and extend as PBS dependants prior to expiry of leave.

Else, unfortunately, there are no provisions for wife to apply for an entry clearance as a PBS dependant.

Then both wife and child may apply for settlement visas under Appendix FM. But wife's qualifying period for SET(M) will be reset.

As time is short, is it feasible for wife to return without 4-month old child and extend in-time as a PBS dependant first?

Where was child born? If child was born outside the UK, then they are likely to refuse a registration under 3(1).

Thank you all for the replies :D
I don't think so she could return and apply for extension from UK with the time frame (25/12/2018).
So, definitely there is no chance for my wife to apply for Tier 2 dependent partner and Tier 2 dependent child visa from India?

The only way I see is through FLR (M) https://www.gov.uk/government/publicati ... -form-flrm applications. So, I have to apply 2 separate applications, one for my wife and one from my child or Can they both apply on the same application. The only downside is that it takes 3 months for a decision and costly.

So, if they would have been in UK I could have taken Tier 2 route?
