PBS Dependent on a Tier 2 (getting his ILR), concerned about my eligibility for ILR and current PBS Visa route

Post by Miribrown » Tue Apr 02, 2019 4:18 am

Hello team,

I'm on a PBS Dependant on my Husband's Tier 2 Visa. My husband is now eligible for ILR this year 2019 which he is about to apply for this April 2019.

Myself will be eligible for ILR in November, 2020 as my 5th year residing in the UK. But since February 2018 I've been in our home country with my little one till now for so many important reasons.

We also have a daughter who is now 3 years old(born in the UK), we weren't able to apply for any Visas for her yet before she travelled back to our home country with me..we came back just before she turned 2 years old last year. Not worried about her because I'm guessing she would become qualified for BC after my husband's ILR.

My First question is, As I've been outside of the UK for One year and 3 months now. Would this very long absence disqualify me if I tried to apply for my ILR by next year November when I'm supposed to become eligible?

Second question is, as my husband is about to apply for his ILR this year 2019, and my current PBS Dependant visa is dependent on his Tier 2, would my current Visa (which doesn't expires till June 2020) still be valid after he gets his ILR this April/May?.
Or would my husband's conversion from Tier 2 visa to getting his ILR, automatically render my PBS Dependant visa INVALID?

Third question is, considering questions 1 and 2, would it be better if I returned back to the UK with my current PBS Dependant visa? (planning for August return). OR DO WE NEED TO SWITCH ME TO SPOUSAL VISA after he gets his ILR??
(Basically is there any need to switch my PBS visa to Spousal visa IF my absense disqualifies me for ILR next year).

OR should we leave me on my PBS Dependant visa and renew it when it expires next year? (if my absense have disqualified me already for my ILR eligibility next year).

I'm so sorry the post is really long and with repetitive explanation. I would greatly appreciate any responses with these information. Its also my very first time on the forum.

Thank you. :(
