Can I go back onto Tier 2 General Visa again whilst living in the UK.

Post by dave999 » Wed Nov 20, 2019 12:19 pm

Hi,

I entered UK in 2010 on a student Visa and then applied for PSW Visa in 2012 and after my PSW Visa expired I applied for Tier 2 Sponsorship Visa in 2014. In May 2017 my Tier 2 Visa expired and couldn't extend my Tier 2 Visa, so I then applied for FLR FP.
My application has been rejected by the home office in Aug 2018 and then I again submitted another FLR FP application.

Now during this application process if I get an opportunity from any company can I still go back to Tier 2 Visa. Will the Home Office consider my Tier 2 Application whilst I'm still living in the UK and waiting on the response to my FLR FP application.

Please if you could advise me that would be really helpful.

Many Thanks...

No. You appear to have been an overstayer since your 3C leave and appeal rights ended in August 2018. Submitting a new applications does not regularise your stay. See https://www.gov.uk/government/publicati ... ily-routes

You can now only apply in your home country, after waiting out a 12-month entry clearance ban on the basis of your overstay. However, given your immigration history, it seems unlikely that any application would be successful.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
