Police case with NFA will it affect visa application

Hi,

Good Morning

I am looking for an advice on my situation as I may be applying for spouse visa as dependent to my girl friend after getting married to her in April 2020. This will be my second marriage



Bit of a background about my situation.



2009 - 2016

============

I have previously stayed in UK for 7 years. I came to UK in 2009 and completed my MSc and worked with multiple companies till September 2016. In September 2016 I decided comeback to India for good.



Things that have happened which concerns me during 2014-2016:

> In 2014 I got married to an Indian girl in my first marriage. I brought her to UK as my dependent(spouse) on Tier 2 General visa in may-June 2014.

> I was on company sponsored Tier 2 General visa at the time of my marriage.

> During my first marriage Lot of things happened and to keep it short, things didn’t work out and we separated.

> She and her mother were vindictive, control freak and harassed my mentally, physically and financially.

> She wanted me to lose my job and my ILR option.

> So, she put lot of allegation (domestic violence, sexual harassment and lot of others) in India court after she returned to India post our separation.

> I started going to India from UK to attend the court once in two months.

> As she was not satisfied in torching me, she landed in UK and filed 3 counts of rape, sexual harassment and domestic violence.

> I was arrested from work and interrogated and released on bail on same day.

> I was completely shocked and felt helpless at that time, but was confident as there was no fault of mine.

> My company never fired me due to my arrest and supported me 100% as they knew I was innocent and it was completely a personal issue.

> I traveled to multiple countries on work from my company (even being on bail). I never had a problem.

> The police investigation took time as they said my case was in backlog. During this time, I got into depression as harassment never stopped and now, she and her mom were targeting my parents in India.

> I completely co-operated and was 100% transparent in everything Met Police wanted to know.

> Police investigated the issue and closed it with NFA (No Further Action) in Aug-Sep 2016.

> But by then I was in serious depression without any fault and being harassed by her & mom. Going through projects at work and attending the court cases every month in India took a toll on me.

> She really took every opportunity to talk to my life and make me loose my job in UK.

> After the police case in UK was closed, I spoke to the investigation officer and told him how depressed I was and felt like going back and spending time with my parents and friends

> I quit my job and completed all formalities in UK, returned to India in September 2016.

> After returning to India I fought the case in Indian court against all her allegation and the case was dropped eventually after 1 year of fighting in the court.

> I have not paid a dime and fought with complete sincerity

> I got my divorce with my first wife in October 2017.





2017 - Current

> Post my divorce in July 2018 I met a girl and fell in love.

> We got closer and closer as months passed. I discussed my complete situation and police case in UK and about my divorce with my ex-wife.

> She was completely OK with my previous issues and accepted me.

> She is a resident of India

> In 2019 her company gave her an opportunity to work in UK and sponsored her Tier 2 General Visa.

> She took the opportunity and left India to work in London, UK.

> She is living in UK from last 8 months.

> We would like to get married sometime in April 2020



Problem:

> I have put lot of effort in recovering from my depression during my divorce and living very happily now in India with a job.

> My girlfriend wants me to come to UK post marriage and live with her.

> We love each other a lot and would like to get married.



My question:

> If I return to UK, I will be applying for Tier 2 General Dependent (Spouse) Visa

> Will my police record of the arrest be a ground to reject my Dependent Visa.

> Will my police record affect my career/ job prospects.



I need an answer before my marriage as she has lot of aspirations in her career and being in UK and if my visa will be rejected, I would like her to move on.
