Tier 2 General - change of sponsor

Post by Russel S » Thu Dec 12, 2019 11:26 am

Hi,
I've got a Tier 2 General visa (start Oct 2019 to Oct 2022) and currently in UK. Recently I got an offer and planning a change of employment, a new cos has been applied and done with the biometrics too.
Start date of the new cos is Feb 2020,my question here is, in this interim period between Dec 2019 and Jan 2020, can I plan a travel back home and travel UK back again by start of February or would there be any constraints here??

Hi, I think you must check this link:
https://www.gov.uk/guidance/immigration ... appLTRinUK

Specifically:

34K. Where proof of identity provided under paragraph 34(5) has been returned to the applicant pending a decision on their application for leave to remain and the applicant travels outside the common travel area their application for leave to remain shall, provided that it has not been determined, be treated as withdrawn on the date that the applicant left the common travel area.

Thanks for the reply..if I understand it right ..I can travel outside post a decision is made until then I’m restricted to travel outside and my application would be withdrawn if I do so...is that it?

Yes, if your application is approved then you have to wait for your new BRP as without that you can not travel outside UK

Hi,

Just want to confirm this,I’ve got my new BRP but when I had a word with the HR team they said they would have to wait for the January allocation meeting for the COS approval .they say it’s a straightforward process and just a tick in a box.my question is ,since I’ve already received my new BRP can i travel out of UK or should I have to wait for the jan month allocation.
