Work permit + unemployed protection

Post by samloh1378 » Sun Jan 18, 2009 9:17 pm

I am on work permit, with current credit crunch I am worried about losing my job. Has been looking to some of the unemployed insurance for my mortgage protection. The insurance provider require me to be able to register to Department of Work and Pension in the event of unemployed.

My questions as below:

1. Can a work permit holder be able to register with Department of Work and Pension when unemployed?

2. Even if I able to register to DWP, would Home Office notices that I am unemployed and issue letter to request me to leave UK as the Leave to Remain invalid when I became unemployed?

3. Is it worth to get the unemployed protection?

Your problem with becoming unemployed will be the loss of the right to remain if you can not find another job and get appropriate PBS entry to the job market. Given the short time scale you would have to find another job this is likely to be your biggest issue.

Do you have any hope of getting a Tier 1 HSMP / General visa?

I imagine that unemployment insurance will be linked to your ability to remain in the UK as a worker and you will find that there is a six month lead in period for most such insurance. You can not claim in the first six months of operating the policy.

Yes, finding a new job for me is a real issue for me, in fact it is impossible!! I work as an assistant architect, vacancy in architectural market is nearly died.

No hope of getting the HSMP as well, I only achieved 65 points.

The unemployment insurance I have been looking at require only 30 days of leading period, I can starting to claim after 30 days when made redundant. I have managed to meet the main requirements, full time worker, not aware of any impending redundancy and a UK residence (live in UK of more than 325 days per year). It is only on the full T&C has a clause to be able to registered with Department of Work and Pension when unemployed.

The agent I spoke with doesn't have a clue of work permit and legal right to remain once I loss the job. What does made me worried is if I register with DWP, it will trigger or made Home Office notices of my unemployment.

It might be more of a chicken and egg set up. DWP may not let you register so no evidence to show insurers etc.... No insurance pay out.

Suggest you contact DWP to see where you stand.

As for UKBA finding out - your employer should tell them that your role and hence work permit has been terminated. They have to fill in a NPEE form.

I thought that contribution based Job Seeker's Allowance is allowed when you are on "no recourse to public funds"

You would still have to find a job pretty quickly or leave the UK though.
