CoS Assignment Procedures for A-Rated Sponsors

Post by PingPong » Mon Apr 29, 2024 5:40 pm

Hello Everyone,

I've been reading through some posts here and noticed discussions about delays in the assignment of the Certificate of Sponsorship (CoS). This has raised a few questions on my end, and I would appreciate any insights from this knowledgeable community.

Could someone please confirm whether being an A-rated sponsor entitles an employer to utilize the super priority service to expedite the CoS process? Also, are there provisions such as pre-paid CoS or a monthly quota system available for A-rated employers?

Additionally, I'm seeking guidance on the recommended steps if the CoS is not assigned within the 60-day window after a curtailment letter is issued.

Furthermore, considering that securing a biometric appointment can be a time-consuming process which may extend beyond the 60-day window, is it possible to complete this step via an app to save time?

Any information or personal experiences shared would be greatly helpful.

Thank you in advance for your assistance.

This pertains to scenarios involving employees who are currently residing in the UK.

A rate sponsor is the basic level and is nothing special.

You can access the priority services like any other sponsor, you have no more rights than any other A rated licence holder.

If you intend to employ migrants subject to a current visa cancellation notice then if you are unable to assign a COS before their visa cancellation date plus 14 days then they will be overstayer and will probably be refused a skilled worker visa.

All COS have to be applied for and you can ask for any number, the Home Office will determine whether they grant you the COS.

Can only apply for biometric appointment through the standard system there is no magic app. The date of application and payment sets the date for the usage of the COS

1)Is it not possible to submit biometrics via the UK Immigration: ID Check app when extending or switching to a Skilled Worker visa, or is a visit to a biometric centre mandatory?

2) If the primary applicant receives sponsorship from a new employer, are the dependents required to apply for a visa extension or a new visa as well? Or do they need not do anything?

3) After which event are we permitted to remain in the UK: once the Certificate of Sponsorship (CoS) is assigned, after the visa application has been submitted to the Home Office or following the biometric appointment?

4) Is an employee on a dependent visa permitted to continue working in the UK if they have applied for a visa extension after the curtailment date of their previous visa has elapsed?

Point 1 - it is possible but you have to have set up an account.

Point 2 - their visas are subject to the same cancellation so must apply in line with the main applicant as dependents.

Point 3 - once the application is made - as long as that is before the expiry of the 60 days.

Point 4 - no they cannot work after the 60th day if they have not applied for a dependent as at point two.
If they don’t apply as per point two they will be overstayers and subject to all that entails.
The other issue is they would not be allowed to work until they were granted a dependent visa.
Overstay for more than 14 days it will be a mandatory refusal in any case.
