Can I overstay VISA if employer is in process of Sponsorship license

Post by albat » Wed Feb 19, 2025 12:20 pm

I have my current Skilled worker VISA about to expire on 15th March and found a new job with serious pay raise.

The problem is new employer doesn't have sponsorship license and already applied. UKVI said it will take 8 weeks.

I am extremely confused what should I do? Is it possible to ask for a few months exception or something from UKVI or do I have to keep working for the current employer?

An exception on what specifically?

If the employer doesn't have a sponsor licence then they cannot employ migrant workers - and I would say they cannot offer a job to a foreign candidate either - nobody can guarantee that the licence will be granted. I think that's quite obvious.

From now until 15 March is less than 8 weeks. I wouldn't rely on something that is uncertain.

If you overstay any subsequent visa application is likely to fall under general grounds for refusal.
