Skilled worker Dependent FLR Refusal

Good Afternoon Friends, I hope you are doing well.

I need some advice for my friend, and any help would be greatly appreciated.

My friend and his wife applied for FLR on 10th October 2024 through XYZ Solicitors. Later, the main applicant applied for a Skilled Worker visa (UK employer) by himself on 5th November 2024. He received approval for a 5-year visa on 10th February 2025.

When they went back to XYZ Solicitors to apply for a dependant visa for his wife, they were informed on 18th February 2025 that both of their FLR applications were refused on 24th December 2024. The decision was made on 24th December, but the solicitors did not inform them until 18th February.

We are seeking advice on what to do now. Some solicitors say her status is now illegal, while others suggest she can still apply for the dependant visa despite the FLR refusal.

We are very confused and would appreciate your guidance.

Can we file a complaint against XYZ Solicitors? Or does she need to return to India to apply for the dependant visa?

They went back to XYZ solicitors and they are making excuses saying they will contact home office to another application.

The timeline doesn't adds up. If your friend got his visa on February 10th how come the FLR was refused on Dec 24? You can only have one application with the HO at the time. Your friend should apply for SAR to understand his immigration status.

As for the wife as she overstayed between the refusal and present (unless she had other valid leave when her FLR refused) my best guess is that any subsequent visa will likely to be refused under general grounds. She should apply for SAR to check whether there is a removal order against her name. Note that overstaying more then 30 days result 12 month re-entry ban.

To the best of my knowledge not all about immigration are supervised by OISC they can also be part of the law society or other governing body.

Can you please advise we have not heard from UK embassy, Solicitors have applied to update for Decision. They have not responded yet.

Can i ask for update direct from home office?

Which UK embassy? Are you in the UK? Do you have UKVI account.
I can't advice anything.

You should apply for SAR it will reveal what is your status, applications made and decisions.
