PSW -> Tier 2 (Same employer, different job title)

Hello all!

I've been working for my current employer for a year now under PSW and technically I'm eligibile to apply for a Tier 2(General) when my PSW runs out (end of October 2009), without having to undergo the resident market labour test. However, my job title is due to change (similar job nature but on an advanced level) and apparently this will not constitute to the "6-months rule". I need to know if this is the case?

As far as I understand from the website, I thought I'll only have to at least worked for 6 months for my current sponsor and continue working for the current sponsor.

Been wrecking my head thinking about this!!

Another thing that has been bugging me, if my job title were to change let's say next week, and in 6 months time, which is mid October, will it be possible if I apply for Tier 2 then? Will it be too late?

mate if u r with the current employer for more than 6 months then its fine...

If Mr X started working as a waiter in O company and got promoted as a chef after 6 months if O is sponsoring Mr X then its totally fine..

The only reason I have doubts now is because (apparently!) my HR department has contacted the UKBA and this is what they've been told..that I will have to hold the exact same position for 6 months.

Anyone has more information in regards to this?

Hi,

My husband worked for 1.5 years for his company, and for the past 5 months in his current position. His company still do the market test after consulting UKBA.
