WP holder lost job - can dependant work? - PLEASE HELP

Post by mouche202 » Wed Nov 11, 2009 3:12 pm

My husband recently lost his job. He has not yet received the home office letter that asks him to leave the country. If he receives it, of course, we will leave but if he doesn't, is he legally allowed to stay here? All info I can find indicates that he can stay here until his FLR expires , which is not for many years. However, the info I found says h can only stay here if he does not work. If he finds a job, he has to apply for Tier 2 - this is fine.

But my query is - if
a) he is not working
b) the 28 days has expired
c) no letter from HO has been received

Can I continue to work on a dependant visa? Or should I quit my job?

Edited to add: I am eligible for Tier 1 but my husband isn't (NARIC does not recognise his Master's degree). However, we are just 9 months away from ILR so ideally we'd like to stay here based on him getting a sponsorship. So me applying for Tier 1 is the last option if the Home Office sends the letter for us to go back, then we will go back and apply. But before we get that letter, I need to know if I am doing something illegal by working.

Check if you are eligible for Tier 1(General), If so, you might be able to apply and your husband can become your Tier 1 dependent.

As far as your working conditions is concerned, I think its tied up with your husbands work permit and leave to remain status, so I am not sure on that. You should wait for others to respond... Best option is to phone up the UKBA work permits helpline and ask..

Actually as i understand and read on the forum.. once ur hubby's company informs HO that he is no more working with them.. the 28days period starts and any stay over that time is overstay and will effect ur future appliactions..

Since ILR is tied up with the main applicant.. your hubby shd get Tier2(G) before the notice arrives.. if not since he is not eligable for Tier1(G). i think u need to go back home and apply for Tier1(G) visa.. but i am not sure about the ILR status at that time.. again becos ur hubby will be dependent and the ILR is tied up with the main applicant..

wait for more confirmed info from others...
