home office cannot confirm entry clearance

Post by girlpower19818 » Mon Jul 19, 2010 9:53 am

hi as documented in my earlier post i have been suspended from work as employer not sure if i am allowed to work despite having appropriate entry clearance.

anywhere I am on a work permit and got entry clearance before entering the country. I have been on the phone to home office this am and they have checked their records then stated that because entry clearance was given abroad they could not verify this in country. they state that the embassy abroad are the ones who can check this.

i thought they should have all these details on file.

You are envisioning a joined-up system. That doesn't exist.

If your entry clearance was granted as a worker and for the sponsor you are working for, and they issued you with the work permit or Certificate of Sponsorship, why on earth does your sponsor not believe you can work for them legally?

as stated on my other post "ILR". my employer has just found out that they are going to be fined, as one of my colleague did not change her leave to remain when she changed employers. technically she has been working illegally .
home office refused her ILR and she is going for a hearing hence my not so knowledgeable employer is panicking and checking everybody's documents.

so even though they applied for the work permit (prior to tier system), they still need to be sure that the rest of the documents I have are correct.
problem is that they have been shown copies of leave to remain and do not get that entry clearance is the same as that (one just gets it out of the country)

1.Ask your employer to call up UKBA and check for himself what the difference between leave to enter and leave to remain is, or
2. The employer can check with any solicitor dealing in immigration matters, or
3.The employer can read the relevant immigration rules (e.g. - para 24 to 30C).

Simple!
