When to apply for CoS?

When to apply for CoS?

Hi

Tried many times to get a "yes" or "no" answer from the UKBA but all they send me is copy and paste replies from the website, which don't answer my question...

Please help.

"Does a Sponsorship company have to wait until the applicant leaves the UK (Tier 5 YMS expires and moving to Tier 2) before they apply for the 'certificate of sponsorship' ref number or can they apply anytime after the expiry of the 'resident labour market test' i.e. after the job centre advert has been on display for 28 days?".

Tier 5 candidates are eligible to switch into tier 2 without leaving UK, if they can score tier 2 points. see following link;

You can't switch from a tier 5 YMS.

To answer the OP's question, you can apply for the COS at any time. Bear in mind that they are not being given out freely currently due to the temporary cap - you will likely need the salary to be in the region of at least 32-36K if it is a non shortage position.

Bear in mind though that once a CoS is assigned it must be used within 3 months (and one day) of the issue date. If it isn't it expires and you won't be able to use it.
