Hi folks,

I am in a strange and tricky situation. I definetely remember seeing on UKBA website last month that I can switch from old work permit (obtained before Nov 2008) to new PBS tier 2 visa.

- I haven't officially resigned from my old job with which I hold a 5 yr work permit (2008-2013), but informally announced that I will be leaving soon.

- My new employer - Cambridge university has already given me a COS last week.

Today, I don't see work permit in this list:

However, this page of UKBA lists it under tier 2 - further leave to remain:

there are whole lots of work permits....

which one is relevant to you?

the least you can do is structure your question so that any person reading your post can get an idea about your situation...

I work in a research institute - academic/bioinformatician position

Got an FLR after my Ph.D as my institute applied for a 5 yr work permit. Not TWES - not PSW.

Don't know whether it has any specific name!

I called UKBA today and the person was confident that I should be eligible, but couldn't explain why it is not listed in the first link.

With a bit of further investigation, I just found out that I would have got the work permit under "Business and Commercial work permit arrangements - non multiple entry". This category is listed in the first link, but I didn't realise what my old work permit is called.

Thanks very much for your time folks. Now I see what Arsenal meant yesterday - structuring question correctly. I wrongly assumed that business and commercial work permit is something that wouldn't have applied to research institutes.

As long as it wasn't a Multiple Entry work permit you should be fine to transition into Tier 2.

Multiple Entry was a daft terminology - all permits allowed multiple entries. But the ones marked Multiple Entry were for people just working here for short periods and based overseas. That's why those ones don't lead to settlement and are excluded from the transitional arrangements.
