HAVING UNSPENT CRIMINAL CONVICTION AND APPLYING FOR TIER 2

Post by ff88 » Fri Jun 03, 2011 6:31 pm

Hello, guys i really need urgent help. I was convicted of drink driving in march 2011, and got conditional discharge from court. My conviction will be spent in March 2012. There is no imprisonment for my offence, because My reading was just a few points above the limit of 35. I was not punished my court as it was my first offence and also because I had no previous criminal convictions and I am and have always been a person of good character.

I have to apply for tier 2 from abroad with unspent criminal conviction of drink and drive. I do know that this conviction dosent fall under paragraph 320 (18). As you must have been convicted of a crime which carries a maximum imprisonment of 12 months or more.

The question now is , even though my conviction doesnt fall under paragraph 320 (18 ) can it come under any other policy ? like public policy grounds, or public order act etc ? What should I do ? Do I need to satisfy the ECO that I am a person of good character ? Do I need to attach any character reference from my employer or previous employer and attach it as a supporting evidence with my application ? Do I also need to attact any court orders with my application or disclosure will be enough ?

Thanks guys, looking for a detailed explanation. I will really appreciate for your time.
