URGENT HELP REQUIRED!! Appeal to Tier 2 (General) refusal

hello,

I have applied to Tier 2 general visa within the country but refused as the English langage certificete was eliminated from the approved list just a day after I sant on the exam and I did not realise that the certificate is not in the list any loger.

After being refused, I sat on TOEFL exam and got more than required points, however, the first-tier tribunal says that newly obtained certifacate cannot be considered. Also, the appeal cannot be approved if there is no error in the law.

Now, I have 3 different TOEFL certificates with ebough scores which all of them are expired 2 years ago.

can I point out that refusing my application is an error of law, as I have had constant ability in English but just could not produce the certificate as I was not aware the certificate I submitted was eliminated from the list?

or shall I just withdraw the appeal and go back to my country and make a fresh application? (the previous visa expired in April 2011)

I m in situation too. home office refused my visa on the grounds that they can not consider my english proficiency test. Which exam you took and when did you take your exam?

The plans were announced on 06-Apr-11, more than 3 months before implementation. So the refusal is due to your own ignorance / fault, rather than "error of law".
