New salary req't for work permitto ilr

Post by oseiboat » Sat Nov 12, 2011 12:15 pm

Had my WP (not tier 2) in Jun 2007. Will be due for ILR in May 2012 but the new salary req't for ILR puts me in a very tricky situation. My salary is way below the SOC. What can I do? Mine is a small business which cannot afford to pay me anymore than what I'm on. At the time of my WP application there was no salary req't. Is this new req't for those of us on the old WP legal? Any ideas pls

Options:
1. Get your employer to increase your salary in line with that prescribed in the COP for your job, or
2. Find a new employer who may be ready to sponsor you under Tier 2 and also pay you at the rate appropriate for your job.

Else, you will not even be able to extend your stay in the UK as a sponsored migrant beyond May 2012, leave alone being eligible for settlement.

Thanks for answering my post. I probably can convince my MD, who is the owner, of the company, to increase my salary in April 2012, a month before I'm due for ILR. i.e pay me more salary for April 2012. This will reflect in my bank statement and on the pay slip. Will one month be enough to meet the new salary requirement? This may sound desperate but I can't waste 5 years of my life. Please advise. Thank you.

UKBA states that it will be.
