Tier 2 (ICT) visa extension queries

I am confused what to select in the Tier 2 form for the application type & for english language section and also some more clarification on the ILR.

My first UK entry clearance given for 1 year

start date was from Jan 15-2009
end date was upto Jan 15-2010

Visa type mentioned as VISA WORK PERMIT in the entry clearance

:: But I entered into UK on 12th April 2009 (86 days later) ::

1st visa extension applied from within UK - it was granted for for 2 years valid until 29th Jan 2012 (jan 15 2010 till 29th jan 2012 = 2 yrs 14 days)

Type of visa / permit : Residence permit T2SW (ICT) MIGRANT (with Employer COS)

and the current leave to remain residence permit expires on Jan 29th 2012, so it will be in total become 3 years 2 weeks as per visa issue (from jan 15 2009 till 29th Jan 2012) but my total stay is from April 12th 2009 till 29th Jan 2012 (2 years 9 months 17 days) from 1st entry clearance till current leave to remain expiry.

I am going for 2nd visa extension with COS for the same employer and the same client now - my application is ready to be sent any moment.

I have a doubt on the

1) Application type - (page 33)

Which one is to choose Tier 2(Intra company transfer) extending leave under 3 years (or) Tier 2(Intra company transfer) extending leave beyond 3 years

2) English language 10 points claiming (page 40) - if I am going for application type : Tier 2(Intra company transfer) extending leave beyond 3 years

N. English Language :

Is it ‘Degree taught in English’

(or)

Evidence not needed as because of (i) but (i) says rules before 6th April 2011 excluding intra-company transfers extending beyond 3 years
Evidence not needed as because of (ii)
Evidence not needed as because of (vi)


Which one to choose ? Please clarify the above two points.

And also please clarify for my condiiton if I am applying for under 3 years they will give 2 years visa extension and I may end up in trouble for PR (ILR) as the time counted for the 5 years would be from the my 1st entry into UK as Apr 12 2009 - so I would need one more extension after this - If I apply for 3 years visa extension now it may be no problem.

Please suggest.
