Post by maryleeda » Tue Dec 20, 2011 10:34 am

CURRENTLY ON post-study work visa(tier 1)

currently work as self-employed contractor (of services) with a licenced sponser, but the problem is that i cant be called an "employee" according to contract despite working for the same company for over 6months and job being on graduate level. Current visa expires Feb 1.

I meet the the maintence fund and language requirement .

what options do you think i have in regards to tier 2 (general) or anyother work visa in the uk..

Advise pls!!!

If you operate as "self-employed" and provide services to "clients" (in your case it seems there is only one client that you perceive to be your employer), how can you expect to be considered as an "employee of a client"?

Options:
1. Tier 2 (General) - but without the concession(s) available to "employees" working for an employer for more than 6 months whilst on Tier 1 (PSW) migrant.
2. Tier 1 (Entrepreneur)
3. Tier 1 (Investor)
Life isn't fair, but you can be!

1. Tier 2 (General) - You must work for the employer full time. No self employment allowed. You must satisfy Salary requirement according to SOC. means you must earn the appropriate salary for your job title as mentioned in SOC.
2. Tier 1 (Entrepreneur)
3. Tier 1 (Investor)
4. No other way for a "work permit"
In three words I can sum up everything I've learned about life: it goes on :)
