Visa refused on RLMT!!!

Post by Noman83 » Tue May 07, 2013 10:33 am

Hi my lawyer has got my documents back today , i do not know the contents of the letter yet but my lawyer says that the visa has been refused on the basis of RLMT not done . This is bit confusing as i was switching from Tier 4 to Tier 2 (G) and i was awarded Bsc (hons) in sep 2012 . My Manager specifically mentioned in the certificate of sponsorship that labour market exemption applies as i have graduated from UK University in 2012 . Any suggestions what is wrong with this??

I applied initially on 17/12/2012 and got the letter on 22/01/2013stating that the application is invalid as they were unable to take the payment (i have bank staements which prove money was always in the account). reapplied on 23/01/2013 with lawyers company acc details gave biometric on 28/02/2013 and got refusal today dated 30/04/2013 stating that when i applied on 23/01/2013 i did not had valid leave to reamin and i had to undergo RLMT so the application was refused although i got points for salary maintainence and english language but could not get points for sponsorship and also did not got the appeal right .Now i want to email Mr caseworker to point out that he overlooked the fact that i initially applied on 17/12/2012 when i had the valid leave to remain which expired on 23/12/2013

In the CoS, what has your employer put down for the question
Have you met the resident labour market test?:
under the section of Migrant's employment ?
Don't take "NO" for an answer if it shouldn't be!!!

This is how it has been mentioned in the CoS I submitted which passed
Have you met the resident labour market test?: Y

Give details of the resident labour market test including where and
when the post was advertised and reference number(s) for mandatory
advertising:

Labour market test not necessary as the candidate
meets exemption for Tier 4 graduates
Don't take "NO" for an answer if it shouldn't be!!!

May be the answer they expect should contain something about your current / last visa status. I believe you have a good case to make an appeal though.

My lawyer has written a letter and an email to the caseworker and in the meantime he is preparing to get the right of appeal from the court as i have not been given the option for appeal
