Locum shifts on Tier 2 visa and effects on ILR application

Hi,

I am a doctor on Tier 2 visa with NHS. There's major doctor shortage as you may be aware hence lots of bank shifts available. I have been doing lots of bank shifts in excess of 20 hours a week sometimes especially during annual leave. It's with my current hospital.

I was under the impression that bank shifts with same trust are counted as overtime for Tier 2 and ILR purposes.

An experienced and quite expensive :( immigration lawyer recently told my colleague in same boat as myself that this will affect ILR application in the future.

Please can anyone shed light on this matter as it's causing us great stress now. There's not much we can do about the past shifts we have done. We need advice going forward as there are still bank shifts booked.

It will affect in the way that you have basically breached terms and conditions of Tier 2

The payslips are exactly the same as my normal ones and from the same trust. Appears exactly same in my bank account and would appear like overtime which is what it is really. I am doing exactly same job as my normal role.

Do you know anybody who has been in this situation before?

I am however quite worried now. What can I do?

Well you have done it already can't do anything about it so stop worrying!

I have re-read your post and I think you will be fine actually. I can't think of anything you have breached here
