Tier 2 dependant extension when spouse is on ILR

Post by Mowgli2018 » Sat Dec 08, 2018 9:08 pm

Hi Team,

I am applying for an extension as a PBS Dependant and have few queries as listed below, greatly appreciate your help on this please.
My partner is now granted ILR (Tier 2 General Sponsored route 5 years). However, when i joined him in the UK he was still on Tier 2 General and i joined him as a PBS Dependant.
Now i am due to apply for an extension need your help with these below

1. I hope am using the correct link and applying using the correct form ?
https://visas-immigration.service.gov.uk/next
2. Sections on this application form that i am a bit confused are as listed below. As the questions refer to when my partner was holding a Tier 2 General Visa.

i. Which visa or permission to stay has Mr xxxx applied for or been granted? Tier 2 (General) leave to remain
ii. Do you have one of these Home Office reference numbers for Mr xxxx? Yes I have their biometric residence permit (BRP) number
iii. BRP number xxxxxxx
iv. Does Mr xxxx have indefinite leave to remain or British citizenship? Yes
v. Is Mr xxxx's work in a shortage occupation? No
vi. What is the length of Mr xxxx's Certificate of Sponsorship (CoS)? 3 years or less
vii. Has Mr xxxxxxx sponsor agreed to certify your maintenance? Yes

Apart from the BRM number, the answers what i put for these above questions refer to my partners Tier 2 General Visa which he is no longer holds

can you please tell me if what i am mentioning on the application is correct ?

Many Thanks,
Mowgli2018

Yes all correct except for the one below.
vii. Has Mr xxxxxxx sponsor agreed to certify your maintenance? Yes
The sponsor cannot certify maintenance for a dependent if the main PBS visa holder now has ILR. You have to submit 90 days banks statements showing £630 per applicant and the funds must have been held at that level for 90 days or more.

And if it the bank statements has to be the Main applicant, can it be the main applicant's Business Account ?

Many Thanks,

You cannot use a Business Account as that money belongs to the business not to you.

The maintenance funds can be either of your personal accounts or joint accounts.

You can apply at any time before your visa expires.

Probably better to do it sooner as the IHS is increasing soon to double what it is now.

Hi CR001,

Thanks for your quick responses,
I need one more clarification please on this below question listed on the application form.

1. Which visa or permission to stay has Mr xxxx applied for or been granted?
I select Tier 2 General (leave to remain)

after this they have a sub question asking

i) Do you have one of these Home Office reference numbers for Mr xxxx ?
I select - Yes, I have their biometric residence permit (BRP) number
the other options listed are (just for your reference)
- Yes, I have their entry clearance number
- No, I do not have a Home Office reference number for them

So, when i select "Yes, i have their biometric residence permit (BRP) number - should i be mentioning my partners Tier 2 Visa BRP Permit Number which he had before he got the ILR or should i be putting the ILR BRP number which he currently holds ?

Many Thanks,

There should be a question asking if the your spouse has ILR, which you will need to tick yes to.

Yes correct, I did tick Yes on the question if my spouse has ILR. Still I get this question to answer !!
The question is as stated below

“Which visa or permission to stay has Mr xxxx applied for or been granted?
Choose the service that Mr xxxx most recently applied for, even if their application is still being processed. If the main applicant has been granted indefinite leave to remain or British Citizenship, you should choose the PBS Tier under which they were granted leave before.”

I select “Tier 2 General (leave to remain)” from a drop down list.

Then it has a subquestion asking
“Do you have one of these Home Office reference numbers for Mr xxxx ?”

This has the options as I listed below and in my previous message

I select - Yes, I have their biometric residence permit (BRP) number
the other options listed are (just for your reference)
- Yes, I have their entry clearance number
- No, I do not have a Home Office reference number for them

So, when i select "Yes, i have their biometric residence permit (BRP) number - should i be mentioning my partners Tier 2 Visa BRP Permit Number which he had before he got the ILR or should i be putting the ILR BRP number which he currently holds ?

Hi CR001,
Request you to please clarify my above query !!
do you think I should put my partners Tier 2 BRP number that he had before he got the ILR ? as its a subquestion under the main question which is

Thanks,

It does state clearly what to say (note, I don't have experience of applying for tier 2 as my route was a different category).
If the main applicant has been granted indefinite leave to remain or British Citizenship, you should choose the PBS Tier under which they were granted leave before.”

actually my query was about the sub-question under the same.

“Do you have one of these Home Office reference numbers for Mr xxxx ?”

which has the options as listed below.

I select - Yes, I have their biometric residence permit (BRP) number
the other options listed are (just for your reference)
- Yes, I have their entry clearance number
- No, I do not have a Home Office reference number for them

You are over thinking.

Simy put their brp number. It won't affect your application, HO have access to your partners full history to check too.

Hmm yeah you r right !!
They obviously can go through my partners details for any doubts.
As per your advice it’s good to go ahead with the current BRP number of my partner 👍
Thanks a lot CR001 😊
I will submit my application this week 😊👍
