Possible to Skip PBS extension to become ILR

Post by kalven » Fri Sep 13, 2019 10:29 am

I have been answered for this question presvious year, but now as the situation been changed and to know if any new schemes been introduced, I would like to know:

I got my ILR - will apply for British citizenship on Jan2020 and my daughter got British citizenship via MN1 already. My wife's current PBS expires on Feb 2020, but she will be eligible for ILR only by Nov 2020. I am not sure if I can extend PBS for one year with less IHS charge? so I can apply for her ILR by Nov 2020. She lived in UK in TIER 5 YMS scheme before PBS for 2 years(2yrs YMS + 4.5 yrs PBS = 6.5 years).

Following that she can be eligible for British straightaway I guess, as we are married for 8 years. Please advise

What date was her initial Tier 2 dependent visa issued??

Your previous posts suggests she qualifies for ILR at the end of 2019 but now you are saying end of 2020. It is useful to be consistent. The same advice as given to you in 2018 still stands. Nothing has changed.

She gets a 3 years extension as dictated by the Immigration Rules Part 8 Para 319D (ii). You cannot choose to pay for a lesser time.

https://www.gov.uk/guidance/immigration ... ly-members
319D. Period and conditions of grant
(a) (i) Entry clearance or limited leave to remain will be granted for a period which expires on the same day as the leave granted to the Relevant Points Based System Migrant or Appendix W Worker, or
(ii) If the Relevant Points-Based System Migrant or Appendix W Worker has indefinite leave to remain as a Relevant Points Based System Migrant or Appendix W Worker, or is, at the same time being granted indefinite leave to remain as a Relevant Points Based System Migrant or Appendix W Worker, or where the Relevant Points-Based System Migrant or Appendix W Worker has since become a British Citizen, leave to remain will be granted to the applicant for a period of 3 years.

Thank you. It is not end of 2020, it expires on Feb 2020. She would eligible from Nov 2020 for ILR. Sorry about that, just double checked recently. Thanks for the advise. I have only this option, but is very expensive :(

What date was her initial tier 2 dependent visa issued? I cannot find this date in any of the 40 odd posts you have made.

Unfortunately then there is no other option but to apply for the 3 year extension.

She will qualify for ilr no sooner than within 28 days before 17th November 2020.

PBS dependent - maintain Funds for 90 days

Post by kalven » Thu Oct 10, 2019 7:11 am

Hi,

I am currently in ILR and my Mrs will extend as PBS dependent. Previously my company used to show funds for my Tier 2 and family in the account as A* company. However, at this time, should I be showing the funds in account for my wife? and if so how is it ? is it £630(funds) + £714 (fees) + £1200(IHS charge) ~ £2600.00 should I maintain in account? please advise

Maintenance funds is only £630 you have to show for 90 days.

The visa fee and IHS is not included in the maintenance fund requirement.

You only need bank statements and the consent form you get online during the application process.
