PBS dependent extension troubles

Post by ServeNVolley » Tue Apr 20, 2021 7:49 am

Hi All,

Hope you are well and safe. I've landed myself in bit of a pickle and can use some advice.

The facts:

1. My current PBS dependent (of Skilled worker) visa expires on 05/05/2021.
2. I have an application in progress for extension of said visa made within UK.
3. The appointment for biometrics submission in UK is booked on 04/05/2021.

I am currently in India, I have had to travel here as mom was hospitalized and ended up getting COVID myself (which is why I had to reschedule the appointment for biometrics to be so last minute).

I fly back to the UK on the 25th, but with India being added on the red List, I have to qurantine in a hotel and cannot make it to a biometrics appointment before 08/05/2021 (which is after the Expiry of my current Visa).

My questions:
1. Is it ok for me to rechedule the biometrics appointment after the visa expiry ?
2. Would I be stopped at immigration as my Visa is due to expire ?

Also, In case case I cannot enter UK or my application is no longer valid because I can't make the biometrics in time -

3. what are my options for Applying for an PBS visa extension from India (Should mention that the partner was previously on a Tier 2 and is now on a ILR so I will be applying as a dependent of an ILR).

Any guidance will be much appreciated. Stay safe all.

Thanks.

Did you apply from India for a new entry clearance visa??

Extensions are only possible within the UK.

No, I applied for a extension from within the UK. I was expecting to be back in the UK for the appointment, which now will not happen.

If you left the UK on the 28th Feb, you cannot have applied within the UK. You have to be physically in the UK to make an application in the UK.

If you had applied within the UK and then left, your application would be considered withdrawn.
