tier 4 refusal and new application help

hi there,

I was refused my visa because my CAS was for 18 month course and UKBA stated that i only have 17 month for my cap limit.
I appealed to first tribunal and it was not successful.

I have again applied for a permission to appeal to upper tribunal but i don't think i will be able to win against UKBA.

If college issues me with new CAS of 12 month ( the college says it will issue me a new cas ), will i be able to make a new fresh application? The college is going to put me in same course but for 12 months.

And if i can, how many days do i have to make a fresh application? Will i have 28 days to make my application if i withdraw my appeal? or do i have to do it immediately?

provided a college is willing to give you a CAS without leave and passport, you will be able to apply with 28 days of your section 3C rights coming to an end, or the withdrawal of your appeal.
