Working Limit 20h per Week + Unpaid Break?

Hi,

I am a PG student holding a Tier 4 visa who is currently working part-time and under the restriction of working 20h a week until the end of my course (i.e. 30 September 2019). However, I would like to ask what constitute works in this case? Does this include everything, paid, unpaid, breaks and such or does it only limited to paid and unpaid work?

For instance, does the following scenario shows the compliant to the visa?
Day 1: 09:30 - 20:00 (total: 10h 30m; work: 10h; a 30m of unpaid break where absolutely no work is done)
Day 2: 09:30 - 20:00 (total: 10h 30m; work: 10h; a 30m of unpaid break where absolutely no work is done)
So in total, there is 21h shift, but the real working time is 20h and that 1h is purely for a break where no work is done and it is unpaid.

Neither the immigration rules nor any related guidance cover this issue specifically. Given that your employer is also legally bound by the 20 hours rule, I advise you discuss it with them. They may have even already checked it with the Home Office for their own immigration compliance.

I assume you stay on the premises, and an employer must give you a break (see https://www.gov.uk/rest-breaks-work), so I think it would be safest to include this time in the 20 hours allowance, but your employer may have come to a different conclusion.
