Switching from Student Visa to Work Visa

Post by awaza » Wed Nov 15, 2023 11:10 pm

Hello,

i am a full time student in UK and my query is related to the eligibility to apply for another visa from home country after securing COS from an employer here in UK.

As a full time student i am only allowed to work for 20 hr per week, however in case an employer wish to employ me on full time bassi and is willing to sponsor the work visa. Knowing that switching from student visa to Work Visa while in UK is not aloowed any more, therefore will I be allowed to apply for work visa from my home country while my student visa is valid ? If yes then how will it work and how should I proceed with it.

Thank you

Yes. Apply for a skilled worker entry clearance from Home country in the normal way.

This illustrates the (environmentally unfriendly) irrationality of preventing students from applying in the UK. Not to mention economic self harm to the UK economy.

This is not correct. The changes in July 2023 only prevent some Students from switching to a work route if they have not yet completed their course.

Degree students who have not yet completed their course can also still apply in the UK as long as the sponsored work starts after they have completed the course.

See Appendix Skilled worker, paragraph SW 1.5A.

What about if someone who’s on a student visa should withdraw from his/her program can he/she apply for a work visa as the person has withdrawn from studies and is no longer a student ?

No. Read SW 1.5A again, specifically part (a) about completing the course.
