Switching from Student Visa to Tier 2 Dependant

Hi,

My husband got a government job and he would like to switch from Student Dependant visa to Tier 2 visa. His organisation is happy to support his application.

I am just wondering if I could switch my Student visa to Tier 2 Dependant visa in the UK? In that case, I could just apply for the switching at the same time as my husband's application. Or do I need to go back to my home country to switch from a main applicant category (Student) to a dependant category (Tier2 dependant)? Does my husband need to come along with me then?

my post above means in order for you to apply for further leave to remain in the UK, you would have needed to have been last granted leave as the dependant on your husband. As you are actually switching roles now, you therefore did not enter the UK as the dependent, and it is of my opinion you will need to apply for entry clearance to the UK.

Sure - your husband's physical presence is not required when you submit from your home country - just make sure you have all the necessary documents, e.g. marriage certificate and required level of funds. It is very much a straight forward entry clearance application otherwise.
