10 points for funds- slightly uncommon bank statement

Post by ZarinaLOK » Sat Sep 03, 2011 8:28 am

Hello, I have submitted my 4 tier application on 26th Aug. I have two issues I am uncrtain about, both related to 10 points granted for funds:

1. "Established presence"- I read carefully a lot of info about it. However, I am still not certain whether I fit in it or not. I have completed one year abroad course as a part of my undergrad degree in the UK under 4 tier in 2009-10 (1 academic year). After that I have had one C-visit visa to the UK. Do I qualify for it? However, just in case I had more money on my account (enough for 9 months) and I wrote on my self-assessment form I need 7200 (amount for 9 months)...but they don't take this literally right? They see for themselves.

2. My bank statements.
2.1. I have two accounts one is in Czech Rep another one in the UK. For the money in the UK I asked my bank to produce bank statement stating the sum and duration during which the money has been untouched (28 days). Due to their "policy" they refused to state the duration it has been untouched for. So I have a letter confirming that on 23rd Aug I had xxxGBP on my account. Additionally to that I asked them to print out transaction statement (to prove 28day thing..). They said ok, but again according to their policy...they can't include my name on it, only the account number (I had a huge fight about it, but basically with no result). So I submitted a letter with all my details and transaction statement without my name. However, I explained it briefly in a cover letter (plus, if officer bothers to look...the bank account number on transactions is linked to my name on cover letter). Do u think this is ok? Or is it a reason for refusal?
2.2. To prove my funds possessed on Czech account I brought like 5 proper original bank statements (that are however in Czech language-but there is nothing to translate, it's just about the date and sum of money). I used same account and same bank statements for all my previous UK visas (I have 5 visit UK visas, 1 student visit, 1 4 tier) and it was always ok never got refused or was never asked for translation (although I know all documents where text is important are meant to be translated). Do you think it's ok?
2.3. In guidance it says, if your course is 9 months long we need to have funds for up to 9 months. What does that mean? We can have less. I need (if I don't have established presence) 7200...but the sum tends to jump 200-300 pounds up and down because of volatile exchange rate. I can't get refused because of 200 pounds out of 25000GBP right?

I am very grateful for whosever help. I know I am probably over-analyzing it, but you know how it is....when you care a lot you worry a lot!
Thanks

1. Established presence is about time spent studying in the UK - if you were studying abroad this won't count, in addition you need to have current entry clearance or leave to remain under Tier 4 to qualify for established presence. From what you have said you don't qualify

2.1 Does the bank statement include the bank's logo? Did you highlight the bank account number on the statement and the letter. They could refuse it due to the lack of name but might allow given the details are on the letter. It depends on the decison maker and possibly the embassy.

2.2 Impossible to say without seeing the bank statement

2.3 £600 for living costs for each month of their course, up to a maximum of 9 months - it is only less than the 9 months if the course is less than 9 months. Yes they can refuse if the exchange rate results in you being being short even if it's by a relatively short amount. The rules are strict.

1. I am not sure if I defined it right. By "studying abroad" I meant I studied/lived in the UK at UCL for one year. If that's how it was understood it's fine. And actually, my partner is British and lives in the UK as we met during that time. It is stated in my application but I don't think it makes any difference.

2.1. Yes, bank statement includes logo and stamp. I did highlight account number on statement of transactions, plus wrote a note on it explaining it and i also included branch managers business card with all contacts just in case.

2.3. Wow, that's bad. However, if I have 4 bank statements and on two I have pretty much exact amount I need and on two it turns out to be less (although I haven't made any transactions, just because of exchange rate volatility) is it still that bad? My course is since 26th Sept-8th Jun..which is 8 months and 14 days exactly...so like this it would be enough one way or another. But I guess they round it up? If not, do you think there is anything I could do? I have more money on other accounts and it's not an issue to get it, but I understand I am not able to contact the person dealing with my application.. .

Thank you very very much for reply and for the whole forum!!!

I misunderstood what you were saying re study abroad but if you didn't have current leave under tier 4 when you made this application then you don't qualify for established presence.
