Tier 4 extension delay.

Hi.

I applied for my tier 4 extension on 18th may 2011, had my bio metrics on 6th june and to-date i haven't heard anything from UKBA. 14 weeks elapsed on 12 september. i called on 13 september and they said its still in process and they cannot give the time frame, i called yesterday as well and there was a recorded message which said ' we are unable to answer to progress of your application if you have applied within last 6 months, this call will now end ' , i am worried now because the timeline is 4-14 weeks after bio metrics, ...

plus.. My visa has expired on 28th june, am i legal to work part time/full time until i receive my passporT?
please advise
