Thanks for replying. Yes HO representative did cross questioning. He asked me about the fees receipts and how much I paid. They refused my application on the basis of Speaking evidence but they couldn’t provide evidences. I don’t know how judge decision will come but Hopefully judge will look all the evidences then finalize the decision.

Had a thought-there’s been so much noise about the windrush scandal, i wonder if the new home secretary will review the Toeic scandal as well.

hii geet..its harpsk. I just want to tell u if ur husband's case is same as mine case..try to get subject access report from home office.u can do it online and u need ur solicitor's sign. That will help u alot.mine is came today but mine appeal is allowed. When i checked subject access report..its totally mess.they mixed my file with somebody else.there r so many papers that r not mine..so its proof of home officers mistake xx.

Really pleased your appeal is allowed. Thanks for the advice about the subject access report. I will ask our solicitor to request it on tuesday. I think we have the same situation as the refusal letter stated i could speak urdu when no where in yhe application did we specify that neither me or my husband could speak urdu. Hi there, I did my toeic test in 2012, in 2015 january immigration detained me, got released in june 2015, JR was struck down in October 2015, now my JR in asylum re submission refusal is pending, can i appeal aginst Toeic test allegations now after December 2017 decision?

Ahsan & others case got the remedy only that out of the country right of appeal is not fair and they got in-country right of appeal. Toeic deception will be decided in lower courts FTT and UT.

You didn't share your case with us so don't know the whole story. How did HO withdraw allegation, what documents have you provided to prove your innocence? Would you mind to share your case?

I arrived to UK in february 2005 on a student visa, my history was great and clear my extensions were done on time until 2014 I used Toiec in my last tier 4 application which was 2013 my tier 4 visa was expired in 2014 I put a new application in 2014 the home office delayed my visa for a year until I finish my course. I finish my course on time i have a certificate as well, but i didnt get a visa. in 2015 they raid my house they arrested for toiec allegations I was detained for only only one day cause they couldnt prove any thing my Lawyer took my out on bail. then we put a JR to FTT I got refused, then I sent a new JR to UT which I won but home office took it further to Court of Appeal which you all know what happen same result they didnt accept home office allegation the result came in AHSAN & ORS allowed an appeal in the country. I received a letter from Government Legal Department saying that the my client which is the home secretary has withdraws for security reason I can paste all the letter but just a part.

ORDER.
Uppon the court considering this appeal under paragragh 6.4 of CPR 52 PDA, and being satisfied there are good and suffient reason to allow the appeal, with out determining the merits.
And upon the respondent agreeing to withdraw the decision and certificate issued pursaunt to section 94 of nationality immigration and assylum act 2002.

IT IS ORDERED BY CONSENT AS FOLLOW:
1. The appeal be allowed, such that the decision is returned to the respondent to remake a decision on the outstanding application.
2. The Respondent pay the appellant reasonable costs in the appeal from 05 december 2017 to date.
A new Decision will be forth coming to the appellant.

I forgot to mentioned that I send a fresh ILR application to home OFFICE in 2016 the new decision will come based on my ILR APPLICATION WHICH WAS REFUSED BY HOME OFFICE WITH NO RIGHT OF APPEAL IN THE COUNTRY .ALHAMDULLILAH I GOT A RIGHT OF APPEAL ON ILR APPLICATION TOO LAST MONTH IN UPPER TRIBUNAL I SEND AN APPEAL ALREADY WAITING FOR THE DATE FROM UT. I HOPES ITS CLEAR.

With the blessings of ALLAH I got the court decision on Thursday and court gave decision on my favor. Means court allowed my appeal. They give 14 days to HO for appeal against this decision. Now I am just waiting and don't know what will happen next?

Hi All,

At the moment am on Tier 2 dependant visa and my visa is expiring on 08/02/2018.
Last month I have been to extension along with Main applicant through premium service but decision was not made on the same day instead they gave the letter saying that our application is valid but they need to do further more enquires as such they have passed our application to other team.

• They have interviewed me has I have used TOEIC in 2013 for my extension. Until now we haven't got any update from them. Even the main applicant visa decision is not made.
  
  So in my case what are the chances of getting visa?
  Just in case if they refuse my visa will they approve main applicant visa as he is working for a proper company on TIER 2 visa.

All your advice's will be vvv helpful for me to take the next step.

Is therr Anyway i can access this so called spread sheet to check the status of my test. If it is invalid or questionable. I have tried to contact with my college but it has closed now.

Some of you has already been to hearings where home office shared the list with you. could you guys please share it here.

We have received an email from home office they are not challenging judges decision again and forwarded our case in Sheffield office for implementation on judges decision and advice us for not make any international travel .
Very happy also my solicitor told us my husband getting visa.
Question is
For how long visa will be issued
As We applied spouse visa first time in Feb 2014 and it was keep going on in court decision, waiting etc and then we applied fresh application in December 2016 which is still on til today and it's on visa processing stage after 4 years will this time will be counted or not.

after first tribunal the judge cleared everything in determinations, the Home office straight away contacted my solicitor and asked for details, today i have recieved my biometric card and i am over the moon.
Judge also said in written that i have a high level of english proficiency and my educational background was impressive.

my watch is over, as they say in Game of thrones,,,,,, the night watch. so wish you all a very best of luck inshallah have faith in Allah and for sure He will help you.

I suppose this is good bye here thanks again to every one on this forum, you guys have been a great help and support for me in hard days, all I want to say is, just never give up.

My educational documents from the U.K.
judge didn’t ask anything HO representative did 7 questions all about test.

That was it really and the judge was annoyed with HO people because my case was different as he said in written. They have just wasted my time.. that’s what they are paid for basically anyways
