BC for one child born in India and another in UK

Post by ILRHelpNeeded » Sun May 19, 2013 6:49 pm

Hi,
I first came to UK in March 2007. My wife and elder daughter (3 year old at that time) arrived UK in April 2007.
My younger daughter was born in UK in November 2010.
Due to some personal reason my family went back to India in March 2011. Their dependent visa got expired in India.
I got my ILR in Feb 2012 and my family came back to UK in June 2012. My wife is now on spouse visa and both daughters are on children visa.
I got my British Citizenship (Naturalisation) in April 2013.
Can my daughters apply for British citizenship now?
My elder daughter is India born and younger daughter is UK born. They lived outside UK from March 2011 to June 2012.
Please advice.

For the child born in the UK:
Section 1(3) applications wrote: Section 1(3) applications - children born in the United Kingdom to parents who are now settled in the United Kingdom

If the child's parent has become settled in the United Kingdom or becomes a British citizen, the child will have an entitlement to register as a British citizen. This registration would be under section 1(3) of the British Nationality Act 1981.
For the child born outside the UK:
Section 3(1) applications wrote:
Applications for registration will be considered at our discretion under section 3(1) of the British Nationality Act 1981. When deciding whether to register a child as a British citizen we will consider:
the child's connection with the United Kingdom; and
where the child's future is likely to lie; and
the parents' views; and
the parents' nationality; and
whether the child is of good character; and
the length of time the child has lived in the United Kingdom; and
any compelling circumstances such as a job offer or other opportunity which requires British citizenship.

There are no formal requirements that the child needs to meet. We will consider the individual circumstances of each application. When you make the application you should make sure you provide us with all the information you think is relevant to the child's case.

Have you read the FAQ before posting?

See Q1 in Citizenship FAQs - Common Questions - Read before posting - children.

For the born abroad child, it is better to wait until your wife has ILR.
