Citizenship for child born (to-be) abrod for parent with ILR

Post by Rama07 » Thu Nov 28, 2013 2:03 pm

Hello All,

Please can some one clarify my confusions on what visa status my born (to-be) child will get when born abroad. Me and my wife hold ILR currently. More details below -

My entry clearance - Mar2008
My entry to UK - Aug2008
My ILR received - 11 Aug2013
My eligibility for BC - Aug 2014
Wife entry to UK - 30Apr2011
Wife ILR - 11 Aug2013 (along with me)

My wife's new baby due date is May2014 and my wife is thinking to give birth to my child abroad (India). My questions here are below -

1. Will my new born child eligible for ILR directly (as both parents are on ILR at the moment) or would the child get Citizenship directly?
2. If my child gets ILR, when he/she will be eligible for British citizenship?
3. When will be my wife eligible for citizenship.
4. As i would get the BC by Aug2014, can i just apply citizenship for my wife under 'spouse to BC' category as she would complete 3 years by Aug2014? (regardless of period she would be away from UK for maternity)?

Appreciate your answers for above please.

-Rama

Have you read the FAQ before posting?

See Q1 & Q2 in Citizenship FAQs - Common Questions - Read before posting.

Scroll down for the section about children. The child will need a settlement visa.

Thanks Jambo.

Now i understand that i need to apply for ILE from India for my child and then after coming to UK, then the child would be eligible for Citizenship when i go for Naturalisation. Am i correct?

Also, regarding my wife citizenship, please can you advise if my wife would be eligible under 'spouse of BC under 3 years stay in UK' even if she is out of UK on Maternity leave?

Yes. Settlement visa to get them to the UK and later registration as BC.

She can't apply with you but once you become British (after the ceremony), she can apply assuming she meets the requirements (less than 270 days away in 3 years, less than 90 days in the last year). If she doesn't meet the requirements, she can still apply but it will subject to discretion.
