MN1 in process PBS dependent Visa expired - Urgent Travel

Post by person.enquiry » Thu Jan 09, 2014 12:22 am

I and my wife got ILR in Dec 2013 and then we applied for our son's registration using MN1 in Dec 13. I applied using NCS service. He is born in UK and his PBS dependent visa is now expired.

MN1 is taking ages and now we have an urgent need to travel Pakistan. He has his Pakistani passport and can travel on it but I am not sure how he can re-enter in the UK? I have few questions.

1) Can I apply for his British passport from Pakistan once I received the registration certificate while he is outside UK?

2)Can he travel back in UK using Paksitani passport after he got his registration certificate and will he be allowed entry based upon registration certificate?

3) Do I have to apply for his ILR from Pakistan? In this case, will he be considered as over stayed because PBS dependent visa is now expired before travelling?

Plz advise thanks

1. Yes
2. At the discretion of the ECO better to get a CoE which usually takes around 4 weeks.

Hi Amber, I have one more question.

Can I apply for Right of abode (COE) inside UK for my son before travelling while MN1 application is still under processing? or do I have to wait for MN1 certificate to come before applying COE? In this case, I would need to apply COE from Pakistan.

Regards,

You will only be able to apply for CoE inside the UK if you have received the naturalisation certificate for your son, without that you will not be able to get CoE.
