Citizenship advice needed for our family

Post by wanderingvas » Tue Sep 03, 2019 7:10 pm

Hi,

My wife was under Tier2 General (from 2014 - till yesterday) and myself as PBS dependent (from 2015 valid till Sep 2020). My son was born in UK on November 2018. We did not apply for his Indian passport as my wife is due to get ILR this month. My wife got her ILR approved yesterday and we would like to apply British passport for our son now. Can you please advise on the below points:

1) For my Son, Can we use MN1 form for his naturalisation? Since he doesn't hold any nationality at the moment? We tried to create a naturalisation application using MN1 and confused with the following questions:

- Are either of the parents of the child (as stated in this application) applying for naturalisation as a British citizen on an AN form?
We have put 'NO'. Please confirm if this is correct as we will ONLY be applying naturalisation next year.

- Have you had settlement in the UK?
We have put 'NO'. assuming this is for applicant (my son). Please confirm if this is correct.

- Have you lived at your current address for 5 years?
As my son stayed at this address since his birth (Nov 2018) which is <5 years, What should we put here?

Your nationality, country and date of birth?
As there is no nationality/passport for my son, what should we select for 'nationality' ?

2) Once my wife become British Citizen next year Sep 2020, can i apply naturalisation directly being on PBS dependent visa (which is valid till Sept 2020) via 'Spouse of British Citizen' route?

Thanks

1. Yes. Note children are registered as British. Only adults are naturalised.

1a. Answer no to the question re parents applying. A UK born child has an entitlement to register as British once EITHER parent is granted ilr.

1b. Answer no to settlement question as not relevent to UK born children.

1c. Since date of birth. Makes no difference as ho will obviously see the child dob.

1d. Indian.

2. No you cannot. You need ilr first. Ok nice you have ilr, you can apply immediately for citizenship if you meet the 3 year spouse of BC requirements.
