Hello,

I have been granted my ILR recently and i would like to apply for the BC baring in mind that my husband is British.

I have been outside the UK in the last 3 years for more than 270 days _ i have spent 346 days in the last three years but not more than 90 days this year. I have traveled back home for around 7 months last year for medical reasons which i have reports to proofe.

My questions are:

1. Would they consider this as a special circumastance and allow me to apply gor the BC if i have submitted the reports to show the reason i exceeded days.

2. Can i still apply for BC

2. If i have to wsit another 1 year after my ILR , what is the maximum days they would disregard on top of the 450 days

For absences of 450 days, you would be expected to be resident in the UK for at least 5 years.

Read from page 9

To apply for British Citizenship, your center of life must be in the UK. The absences rules are there to spot if anyone is living part time in the UK or if UK is a secondary residence.
346 days in the last three years
The rule is maximum 270 days absence per 3 years (average of 90 days per yer) but they normally disregard absence up to 300 days.

Thank you for yohr reply.

I have seen un the guidance that they would disregard 540 days if i was married to a british citizen and havent spent more than 450 days in the last 4 years.

I have been in the since Nov 2014 and i have been working full time since then and my kids goes to school.

Would i be eligible to apply under the 540 days disregrded as i mentioned that i have been away in the last 4 years more than 450.

Also to add that when i was outside tge UK i was on a maternity leave and spent some time with family .

The longest leave was for medical reasons as j mentioned in my first query. But other tgan that my life is based in the UK

You can read the link about and see which eligibility period fits best your absences from the UK.

Make sure you calculate right because the risk is refusal and loss of application fees.

If you are unsure, wait until you have a good eligibility period without too many absences.
