Born outside UK, lived for 12 years

Post by happiestdays » Thu Apr 23, 2020 11:54 am

Hi.
My parents are from a non EU country and I have their citizenship as well. I was born outside the UK and my family moved to the uk when I was little (under 1.5 years old). Then, we lived in the UK for 12 years, but never got a passport. My parents moved back to their home country (I didn't want to but didn't have a choice I guess). I had permanent residency and ILR, but now I'm 17 and it's expired. Am I eligible for British citizenship?

Simply put, no.

For a minor born abroad and under 18 years old to apply for British citizenship, at least one parent should already be British and the child and other parent should both have ILR/PR.

On or after your 18th birthday, the requirements that you need to meet are that you need to have been physically present in the UK exactly five years before the date of your citizenship application, that you should not have been absent from the UK for more than 450 days in the five years immediately before the date of application and no more than 90 days in the year immediately before the date of application. From your description, you do not seem to meet these requirements.

Hello

I always considered a crime against humanity to take these kind of decisions for a kid who doesn't know better.

Someone from my own family used to live in Switzerland. When he got his citizenship, he left the country taking his wife and kids who only had permanent residences at the time. They were all in Switzerland for 15 years+ and the kids were born there. I pleaded with him to stay a few months more and apply for the citizenship for his kids. He didn't want to and they left.

Now, many years later, his kids grew older and despite being born in Switzerland, they cannot travel anywhere without a visa. The father still travels with his Swiss passport.

My little daughter has 3 citizenship and I would gladly get her a fourth and fifth if I could. You don't know how the world would look like when she is an adult.

All the best!

Thanks for the help, guys. That's quite sad. Hopefully I'll be able to return in the future. Also, I think there is a chance that Scotland will become independent and change it's citizenship requirements and I'll be eligible (I lived in Scotland).
