ILR (5 years) to British Citizenship question

Post by Nameless123 » Sun Nov 22, 2020 12:32 pm

Hi,

This is my first post in this forum. My sincere apologies if this is not the right way to ask questions. I have a question in relation to applying for British Citizenship after obtaining ILR and the impact of a ‘gap’ in issued ‘leave to remain’ visas (this was due to Covid processing delay). My situation is as follows:

I’ve lived in UK since 2008. I applied for ILR in May 2020( Leave to remain in Tier 2 visa was due to expire in Aug 2020) on the basis of 5 years residence/work. It was a ILR Set O application. Due to Covid processing delays, I received my ILR in November (last week). I take it that I have incurred a ‘gap’ of two(ish) months in my continued residence (!?)
Previous leave to remain expired: Aug 2020
Issue date on ILR: Nov 2020

I wanted to check if this will have an impact on my British citizenship application which I intend to apply in a year’s time? Should I be doing anything about this?

Thanks for reading and your time. I will really appreciate a response. Many thanks.

There was no 'gap' as such. As you submitted your SET(O) application before your visa expired, you were covered by Section 3c of the Immigration Rules while your application was being processed.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Many thanks Casa. I really appreciate you taking the time to reply. I was paranoid about the potential impact of this in my next application; thanks for clarifying this. Have a lovely Sunday, cheers!
