BC Eligibility Check for Partner & Child

Hello,

I’m naturalised British citizen from Dec 2020. My dependants (Wife&Child) received ILR recently in Nov 2020

I am about to make naturalisation application for my wife as Spouse of British citizenship. But want to make sure for eligibility, Can anyone please confirm for below,

1. She cannot be eligible under 5+1 year route due to excess absence from Jan 2016- Oct 2017. But From Oct 2017 – till Present, last 3 years she only had one absence up to 103 Days. Is this okay to apply as Spouse of BC?

2. I would want to know if I can include my child (Born outside UK) under 18 in the same online application. (OR) should I make a separate application for the child under MN1 online

1) She will apply under Section 6(2) BNA 1981. 3 years residence requirement. Not more than 270 days outside in the last 3 years and not more than 90 days in the last 1 year. Also, physically present in UK at the start of the 3 year qualifying period.

2) Yes. The form will automatically adapt to MN1. Your wife can create an account and fill her AN form first. The child can be added in the same account as “child below 18” then. You will fill a separate form for the child but in the same account.
