MN1 in progress - but heading to home country

Post by Aaryasrini » Sat Jan 22, 2022 7:53 pm

hi..

I have applied for my daughter's MN1 registrtion for british citizen on 5th Nov - biometric on 7th Nov. Daughter was born in London and both me & my wife are ILR holders. It has been 2+ months since biometric - i havent heard from UK Visas. Given i had applied for citizenship; we havent renewed her UK dependent visa.

There is a medical exigency back home and we need to travel urgently. While i understand that my daughter will not be able to enter back into UK (as her visa has expired and her registration for british citizenship hasnt been received yet); would her registration for british citizenship application get nullified/cancelled if my daughter leaves the country?

in case the application gets nullified; will we be able to reapply for MN1 (while my daughter is still in India)? OR should we apply for her dependent ILR first - get her to country and then start MN1 again?

The risk is that her certificate is sent to your home address while you are away. As she doesn't have a visa or a British passport, she won't be able to return to the UK. If she becomes British while you are away, she cannot apply for a visa as a British citizen cannot hold a visa for the UK as they are not subject to immigration control. You could apply for certificate of entitlement to right of abode once she is British, but you possibly would need the original certificate to do this.

Note also that she loses her Indian citizenship the day she becomes British, ie the date on the Registration certificate.

To add to CR001's response above, as she loses her Indian citizenship automatically on becoming a British citizen, your daughter also can not apply for a CoE-RoA in an Indian passport (as she will lose entitlement to an Indian passport) and will need to apply for a British passport, which can take six months to a year when applied for abroad.

CoE-RoA in an Indian passport is an option for children born with both British and Indian citizenship, but not for children who were registered as British citizens after birth.
