Parental Consent Requirement if Divorced

Hello,

I am applying for UK citizenship under UKM (born outside of the UK to British mother before 1983). I am also applying for my 16 year old child under MN1. The child's father and I are divorced. Do I need parental consent from both parents or is mine alone allowable?

Can you prove sole responsibility, ideally by means of a court order granting you custody?

I do not have sole custody (according to the court order from 2011) but I can show estrangement and no contact for the last 2 1/2 years.

Sole responsibility is a complex topic and i will leave it for others to advise on that.

What is the basis of registering your 16 year old son as a British citizen? Have you and/or your son lived in the UK for any length of time?

The general rule of thumb is that British citizenship can only be passed on one generation outside the UK. So, while you certainly qualify, your son may not.

We are hoping to move to England right after he turns 18 but I have heard that it is better/easier to try and get him citizenship before he turns 18. Is this the case, or is there a better way for me to go about this?
