Citizenship under new immigration law

Under new immigration rule 2009 the Act will allow British Nationals (Overseas) to be registered under section 4B of the British Nationality Act 1981 if they do not hold any other citizenship or nationality.

The UK Border Agency recently announced changes to British nationality law under the Borders, Citizenship and Immigration Act 2009. These changes, which we described in a news story on 3 August, will be commenced on 13 January 2010.

My status: BN(O) with no nationality.
Present stay: In U.K student visa( 7years as a student)
My dependent: Spouse visa of a student.(7 years as dependent)
My current stay expired Nov.2009
Present application: extension of a student visa( result awaiting)

QUESTION:
1. It is confirmed by Home office that i can apply for my citizenship rights from 13 January 2010. What is the advise for my spouse who is living with me since i am student in U.K?
2. If my student visa not approved by Home office, does it will lead to any problem for me and for my spouse.
