Earned citizenship introduction and graced period?

Post by soulfullness » Sat Apr 03, 2010 8:35 am

Hi

When earned citizenship is introduced in July 2011, the people who already posses ILR be treated under current rule for 2 years of grace period or they will be dealt with rule introduced from July 2011?

Any comment on this please as the web site make me little confusion as per following two statement.

â– If a migrant has already been given indefinite leave to remain (also known as settlement) on the date when earned citizenship is introduced, they will automatically be considered to be a 'permanent resident'. They will not need to pay or apply for this to occur. They will be eligible to apply for British citizenship under the current rules during the first two years after earned citizenship is introduced

All applications for indefinite leave to remain and British citizenship received before earned citizenship is introduced will be dealt with under the current system.

I don't see any contradiction. Those two statements are clearly for two different periods of time.

Hi John

Thank John for the comment and can you comment on this to get away with my confusion please.

1) A person who already have ILR before introduction of Earned citizenship, ( say ILR holders from 30 June 2011), so they can apply for citizenship under current rules in 29 June 2012 though earned ctizenship is introduced in July 2011? and they can do so under current rules till July 2013!

That is my reading of the situation. But we should not lose sight of the fact that the UK will have a General Election soon, and clearly no guarantee can be given about the legislation that will be in force in the years that are being mentioned in this topic.
