Hi everybody, I did my best in researching but still uncertain.
Hope I dont get flamed. Its pretty simple.

I came to the UK as a student in June Of 2008 and took a 3 week holiday,
done with my studies in 2010 and returned home the same time the visa ended, was at out of UK for a total of 170 days.
got married to ny BC spouse while at home, came back to UK on ILE( no restrictions) on December 2010.
So since I last came I havent left the UK for 16 months

It says I need to be in the country for 3 years as a resident to apply for BC as a spouse.
According to my situation can I apply for naturalisation even though I had no UK visa for the missing 170 days?

<< I just want to know if my absence of 170 days 'break' the 3 years residency, even though I was in UK soil for more than nearly 3 years as a student and more than a year as ILE holder>>

Please let me know for additional info.

Thank you very much for reading and helping me out.

If you meet the requirements, you can apply.

There is no requirement to have a visa for the whole period. See similar question - Absence (NO UK visa) during 5 yrs resi qualifying period
