Confusion on Spouse's Entry Date

Hi,

If this question has been asked previously, please do apology.

My wife came to UK in Aug 2007 as dependant of work permit holder and then went back to Pakistan in March 2008.

My work permit visa was valid till July 2008 and I changed my work visa in July 2008 to Tier-1. My wife was still in Pakistan during that time. Of course, her dependant visa was also expired in July 2008. I again applied for her visa from Pakistan as dependant of Tier-1. She joined me again in October 2008. There was a gap of 2 months between her two visas (WP and Tier-1). Work visa was expired in July and Tier-1 visa was granted in September.

We successfully received ILR last year and now intending to apply for naturalization based on 5 years stay (post 1 yrs ILR).

My questions are:

1. From which date spouse stay will be counted towards naturalisation? Aug 2007 or Oct 2008?

2. Is there any problem for having gap between two visas?

Her total stay in 5 years is less than 450 days, even if I consider Aug 2007 as start date.

Any thoughts / comments will be much appreciated.

The figure 450 is in reference to "absences from UK" and not "stay in UK".

Typo - should read as, her total stay outside UK in 5 years ............................... :)
