British Passport for Kid

My Status - I was on Tier 2 ICT visa when my kid was born; currently have an ILR / PR.
My Husband's Status - He was on a Tier 2 ICT visa when kid was born; currently has a Tier 1 visa (valid until June 2013).
My Kid's status - Kid Was born in the UK in 2010; Indian Passport obtained in Jul 2010; Travelled to India end Aug 2010 without UK visa and returned back from India in Oct 2010 as my husband's dependent on Tier 2 ICT (entry clearance) visa. Currently is my husband's Tier 1 dependent.
Me and my husband are not on dependent visas. Kid has a UK birth certificate. Both the Indian passport and the UK Birth certificate for the kid has both our names as parents.
Please advise if kid (on father's Tier 1 dependent visa currently) is eligible for British passport given I (mom) have an ILR now.
