I have been told that your Forum is the best on Immigration Advice... so here goes..

I have been in the UK since early 2002 (nearly 11 yrs now). I got 3 years H1 for USA in 2005/6 but decided not to go as I met my then GF in the UK. We got married in late 2008.

I got my ILR in early 2011 based on British Spouse Category. the problem is we now are divorced and I am not sure how soon can I apply for my BC. as I am divorced now can I still qualify for the 3 years period or what?.

please advice me..

1. where I stand in terms of my BC application ( Spouce / general)?
2. how soon can i apply for my Naturalization.
3. what is the procedure for it.
4. how long / current waiting time the HO takes on application process / decision

1. Depends on how long you have legally been in the UK - residence requirements for naturalisation as BC is 5 years in general or 3 years if married to a BC
2. As per point 1 - what is your immigration history from the beginning

4. Depends on how busy UKBA are - my application took 6 weeks but it can take longer.

I came as a Student and most of time I was studying.. thn got married in 2008.

I have been legally in the UK all my time.. no crime.. never broke any immigration rules etc.

so you saying that I can apply for Naturalisation now as I have been in the UK legally all the time?

Yes, you can apply now and the link I provided in point 3 explains what you need to do. It is the 5 years immediately before you apply that matters. I would advise to apply using the NCS (nationality checking service) at your local council because that way you can keep your original documents and passport.

You also need to make sure you meet the requirements regarding absence :
max 450 days in the last 5 years and max 90 days in the last 12 months.
