Hello,

I have a query regarding ILR & naturalization.

I came to England on 10th march 2010 on Tier -1 dependent visa. My husband got the ILR on 25th on July 2011 and he got his naturalization done on 20th dec 2012.

I am still on Tier -1 dependent visa which will expire on 16th june 2013 and i am eligible to apply for ILR right now.

My query is: As my husband is now a British citizen so can i directly apply for naturalization on 10th march 2013 ( i will complete my 3 years in UK) or i need to go for ILR first and then for naturalization in due course.

I will really appreciate your advice on this topic.

Thanks in Advance

Regards
Charu Malik

Thanks for your reply.

However , i was just scrolling through UKBA site and it says that partner of British citizen have to spend 3 year in UK and then straight apply for naturalization.

The ILR requirement on the UKBA website (i.e. URL link you have referred to) is stated as follows:

Immigration time restrictions

You must be free from immigration time restrictions on the day you make your application.

You will not be free from immigration time restrictions unless you have ILR.

The same page also says
You must be free from immigration time restrictions on the day you make your application.
which you only going to be once you have ILR.
