Hi,

I have question .
I am on ILR and will be applying Child registration as a British Citizen under section 1(3) using MN1 . we need to travel in April to home country .
Child was born in uk and is resident in uk and is currently on Tier 1 Dependant which will expire on 21.02.2013
Should I apply for ILR Dependant for child or sent the MN1 application before current leaves expires and once application is submitted child can travel.

thanks for your answers in advance

Is the child a visa national?

The child will not have problems leaving the UK but the return could be a problem if the child doesn't hold a valid visa and is a visa national. The airline will not let him board the flight. If he can get to the border and present his registration certificate, he would be allowed to enter. If his application is not approved by the time he travels back, and he is not a visa national, his entry depends on the discretion of the IO but it should be fine.
