UK born child MN1 - not holding ILR - is he an over stayer??

Hi All,

My son was born in UK in 2010. He currently holds a Tier 1 dependant visa which will expire in a couple of weeks. Myself and my wife got ILR this week and received our BRP today.
I intend to register my son for British Citizenship using MN1 under section 1(3). The case worker who approved our ILR case got me really worried by saying "Your son's ILR application should have been included in your application ..."

We dont have any travel plans.
1. Is there any complication by not applying ILR for my son?
2. His current dependant visa will expire in 3 weeks - Will he become an over stayer after that?

Please tell me i am really worried.

Your UK born child's immigration does not come into question on the child's registration application under section 1(3).

I do agree. I did the same thing as U did @shahid2000 (UK Born child).
